STUDIO GINA | Terms & Conditions
The terms and conditions for Studio Gina apply to all services provided by Studio Gina. By booking and receiving any of these services, clients agree to be bound by these terms and conditions. These terms and conditions shall govern the relationship between Studio Gina and the client and shall prevail over any other terms and conditions, unless otherwise agreed in writing by an authorised representative of Studio Gina.
In-Home Colour Edit/Interior Flow/Exterior Flow/Restyling Consultation Service
The In-Home consultation services start with a free 15-minute discovery call. Once confirmation of booking is received, a pre-appointment questionnaire will be provided which will need to be returned directly to Studio Gina at least 24 hours prior to the appointment.
Appointments are charged at £400 (£750 for Exterior Flow) payable in advance at the time of booking (for up to two hours, then subsequent charges of £100 for each half-hour booked thereafter).
For this fee you will receive a visit to your home from Studio Gina to discuss colour schemes/Interior Design/Garden Design/ Restyling.
Post-consultation, a written specification may be provided, including as follows (as agreed with the client):-
For Colour Edit – paint schedule along with paper paint samples for reference
Interior Flow - interior design specification and shopping list
Exterior Flow - garden design specification, shopping list and 2-D layout drawing (not to scale)
Restyling - advice specification, and layout plan (not to scale)
In the event that Studio Gina is required to travel more than 15 miles from Marlow town centre, Buckinghamshire, there will be an additional charge for mileage at 45p per mile. This will be discussed with the client in advance and payable at the time of booking.
All subsequent services to be provided by Studio Gina will be charged in accordance with an agreed scope of work set out in a proposal at our hourly rate, unless otherwise agreed.
Online Colour Edit/Interior Flow/Exterior Flow/Restyling Consultation Service
The Online consultation services are charged at £400 (£750 for Exterior Flow) payable in advance at the time of booking (for up to two hours). For this fee you will receive an online consultation with Studio Gina to discuss colour schemes/Interior Design/Garden Design
Your booking confirmation email will include a Zoom link which you will need in order to join the consultation. If you have any concerns about access to Zoom, please advise when confirming your appointment.
A pre-call questionnaire will form part of the consultation and as such will need to be returned directly to Studio Gina at least 24 hours prior to the appointment.
The deliverables from the call will be agreed as part of the consultation.
All subsequent services to be provided by Studio Gina will be charged in accordance with an agreed scope of work set out in a proposal at our hourly rate, unless otherwise agreed.
General Terms
We charge to the nearest hour. If your consultation lasts less than one hour no refund shall be made. If it lasts more than two hours an additional charge may be incurred and should be paid at the time of the consultation prior to the additional time being delivered.
The Colour Edit Service (whether face to face or online) is an aesthetic advisory service only, providing advice in relation to colour schemes. Drawings illustrating the design are not provided, neither is it a project management service and a proposal for providing this service may be supplied by Studio Gina on request. The cost of paint and wallpaper is not included in the consultation fee.
The Interior Flow service (whether face to face or online) is an advisory service with advice given in relation to interior layout, wallpaper, fabrics, furniture, and design advice to help a project run smoothly. The estimated cost of supplying the recommended items may be included in a written specification with links and a proposal for providing this service may be supplied by Studio Gina on request.
The Exterior Flow service (whether face to face or online) is an advisory service with advice given in relation to the garden, layout, plants, trees, hard landscaping and to produce a hand drawn sketch on an ipad, with a specification list with links and a proposal for providing this service may be supplied by Studio Gina on request.
The Restyling services (whether face to face or online) is an advisory service to provide advice on the layout/colours/changing around room use to help aid sale or rental. This could involve the recommendation to remove items into storage. Also purchasing new items if there isn’t the item in your home, but the client will always be advised and budget will always be considered and a proposal for providing this service may be supplied by Studio Gina on request.
Cancellation of Appointments
Please note cancellations/change of consultation date/time can be made up to 2 business days prior to the appointment date. If the consultation is cancelled within 48 hours of the appointment, no refund will be made. If the consultation is moved within 48 hours of the appointment, no refund will be given and an additional charge may be made for the next appointment.
Payment terms
All other consultancy services provided by Studio Gina are charged at an hourly rate as specified in the agreed proposal and payable in advance at the time of booking. Mileage costs will be agreed and are payable in advance also. Any other expenses incurred by Studio Gina on behalf of the client, such as materials, will be invoiced separately and are payable on receipt.
Our rates are subject to periodic inflationary adjustments. Studio Gina reserves the right to increase its fees annually in line with the Consumer Price Index (CPI) or another relevant inflation measure. Clients will be notified of any such adjustments at least 30 days in advance. The adjusted rates will apply to all services provided after the effective date of the adjustment.
Liabilities and responsibilities
Studio Gina strives to deliver design schemes that meet the client's expectations. However, it is essential for clients to actively participate in the design process to achieve the desired outcome. Clients are encouraged to communicate their preferences, ideas, and feedback during the course of consultations to ensure that the final design aligns with their vision. Studio Gina cannot be held liable if a client is dissatisfied with a design scheme due to a lack of communication or failure to provide input during the consultation process. It is the client's responsibility to voice any concerns or preferences to Studio Gina during the consultation to facilitate the creation of a design that meets their expectations.
Please note that paint colours may appear different on walls than they do in pots. This variation is due to factors such as lighting, the presence of other furniture, and the overall environment of the room. We strongly recommend that clients test a small area on the actual wall or woodwork. before proceeding with painting the entire area. This will help ensure that the chosen colour meets your expectations.
Studio Gina will be your point of contact after your consultation. They will provide a detailed paint specification for you to place your order. However, it is not the responsibility of a member of the Studio Gina team to be onsite to meet deliveries or liaise with third party contractors.
Any estimated quantities of product required are provided in good faith. We advise that you or your chosen contractor check and confirm quantities of all products prior to placing your order. Advice given in relation to application is also given in good faith, and you should confirm your individual requirements with your contractor.
Studio Gina will use reasonable endeavours to attend on the day and time agreed. However Studio Gina shall not be liable in relation to any matter (e.g. cancelled appointments or late arrival for an appointment) where such default arises as a result of any force majeure event outside their reasonable control including (but not limited to) travel disruption.
Except as expressly set out in these terms and conditions and by law, Studio Gina shall not be liable for any loss or damage including indirect, incidental or consequential losses (e.g. any additional contractor costs) howsoever arising as a result of the Services. Studio Gina’s maximum liability for its supply of Services is limited to the value of the professional fees paid by the client to Studio Gina by the Client for (a) incorrect, negligent or misleading advice, (b) any delayed or cancelled appointment or failure to adhere to agreed deadlines (c) changes made to original plans without the client’s express approval (d) failure to meet a client’s expectations (e) damage to property as a consequence of the services or advice and (f) failure to comply with building laws or regulations. Your statutory rights as a consumer are not affected.
Studio Gina provides interior and exterior design consultation services only. The services offered do not include architectural or structural advice. Studio Gina is not qualified to provide such advice, and any information or suggestions provided during the consultation should not be construed as architectural or structural recommendations. Clients are advised to seek the services of a qualified architect or structural engineer for any architectural or structural matters. Studio Gina shall not be liable for any loss or damage arising from the client's reliance on any architectural or structural advice purportedly provided during the consultation.
Studio Gina provides its services on an "as is" basis and makes no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or completeness of any advice, designs, drawings, specifications, or other materials provided. Studio Gina does not warrant that the services will meet the client's requirements or that the results will be satisfactory. Any warranties or guarantees provided by third-party manufacturers or suppliers of products used in the project are the sole responsibility of those third parties, and Studio Gina shall not be liable for any defects or issues arising from such products. Clients are encouraged to review and understand the terms of any warranties or guarantees offered by third-party manufacturers or suppliers.
Confidentiality
All information shared between the client and Studio Gina during the course of the consultation, including but not limited to designs, drawings, specifications, and any other materials, shall be treated as confidential. Studio Gina agrees not to disclose any such information to third parties without the prior written consent of the client, except as required by law. Similarly, the client agrees not to disclose any proprietary information or materials provided by Studio Gina to third parties without prior written consent. Both parties shall take all reasonable measures to ensure that confidential information is protected against unauthorised access, use, or disclosure.
Intellectual Property
All designs, drawings, specifications, and other materials provided by Studio Gina, whether in physical or digital form, are the exclusive property of Studio Gina. These materials are protected by copyright and other intellectual property laws. Clients are granted a non-exclusive, non-transferable licence to use these materials solely for the purpose for which they were provided. Clients may not reproduce, distribute, or create derivative works from these materials without the prior written consent of Studio Gina. Any unauthorised use of these materials may result in legal action. Studio Gina retains the right to use any designs, drawings, specifications, and other materials created during the course of the project for promotional purposes, including but not limited to, showcasing the work in portfolios, on the Studio Gina website, and in marketing materials. Clients agree to allow Studio Gina to photograph the completed project and use these photographs for promotional purposes, provided that the client's privacy is respected and no sensitive information is disclosed. In the event of project termination, Studio Gina will retain ownership of all intellectual property created up to the point of termination. Clients will be provided with a non-exclusive, non-transferable licence to use the materials created up to that point for the purpose for which they were provided, subject to full payment of all fees owed to Studio Gina. Any unauthorised use of Studio Gina's designs, drawings, specifications, or other materials, including but not limited to reproduction, distribution, or creation of derivative works, will be considered a breach of these terms and conditions. In the event of such a breach, Studio Gina reserves the right to take legal action to enforce its intellectual property rights. This may include seeking injunctive relief to prevent further unauthorised use, as well as claiming damages for any losses incurred as a result of the unauthorised use. Clients found to be in breach of this clause may also be liable for any legal costs incurred by Studio Gina in enforcing its rights.
Termination
Either party may terminate the agreement for ongoing consultancy services by providing 7 days' written notice to the other party. In the event of termination, the client shall be liable to pay for all services rendered and expenses incurred up to the date of termination.
General
Studio Gina shall not be liable for any failure or delay in performing its obligations under these terms and conditions if such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, strikes, or government actions. In such cases, Studio Gina will make reasonable efforts to resume services as soon as possible.
Time shall not be of the essence in relation to the performance of Studio Gina's obligations under these terms and conditions. While Studio Gina will make reasonable efforts to meet agreed deadlines, any delays shall not constitute a breach of these terms and conditions, and Studio Gina shall not be liable for any loss or damage arising from such delays.
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
